The recruiter called and asked about my background, but then directly asked if I am a U.S. citizen or green card holder. I explained that I have valid long-term work authorization and do not require sponsorship. Despite that, I was told this could still be a problem. This kind of question is inappropriate and goes against federal employment law. What’s more concerning is that the company states in its job description that it is an equal opportunity employer and does not discriminate based on national origin or immigration status — but in my experience, that commitment was not upheld. According to the U.S. Department of Justice and USCIS, it is illegal to treat individuals differently in hiring based on whether they are U.S. citizens, permanent residents, or have other valid work authorization.
