A claimant was involved in an accident were she was making a left turn from a parking lot. Her view was not 100% clear, as she moved to gain a better view a vehicle driven by a minor was traveling above the posted 25mph speed limit. The vehicles collided, the claimant stated that the driver apologizing to her stated that he was speeding. His parents arrived at the accident scene and because the driver was a minor his parents gave the statement to the police, and the minor was allowed to leave the scene. The police report did not contain any mention of speeding because of this the claimant was found to be 100% liable because the insured vehicle had control of the lane. The claimant did feel that she should have held some of the liability, but felt that 100% was not a fair outcome.
