Put in 5% regardless of your contribution. Vested after 3 years.

They don't match 401k but have profit sharing that you don't have to contribute to

<Amount of contribution is average 4.5-5% but they don't require you to put anything in for them to make a contribution to your account.>> 3 to 5 %. And its at company's discretion based on profits for the year. If they lose money, your 3 to 5% of zero, is zero.
<<Company won't match in first year of employment>>
There is no matching, re-read your policy manual. Unless you mean you've made zero contribution, in which case, they also made zero contribution. That's the only matching I can see.
Bio-Rad Laboratories
Maybe a little confusing. Bio-Rad has contributed to its employees' 401K accounts at 5% for over a decade regardless of the profit margin (in the US where profit sharing is in effect). That means even for employees who DIDN'T contribute their own funds, Bio-Rad still provided the 5%. "Profit Sharing" is simply the mechanism Bio-Rad provides the benefit (versus "matching"). Perhaps the term "Profit" gets misconstrued in this case.

Best thing is that employer contributions begin from day one automatically, worst thing is that you are 0% vested until 3 year anniversary (but 100% at that point).
