Employees of rail equipment suppliers Faiveley Transport S.A. (and Knorr-Bremse, and Wabtec, which now owns Faiveley) have filed suit in Maryland and Pennsylvania federal court over an alleged long-running agreement between the rivals not to poach each other’s workers, after the U.S. Department of Justice reached a settlement with the companies in May 2018. A proposed class of current and former Faiveley employees (and Wabtec and Knorr-Bremse), filed their complaint in April and May 2018 over no-poach agreements that were in place from 2009 until 2016.

Cons

If you are a current or former employee of former Faiveley employees (and Wabtec and Knorr-Bremse), then you may join the class in the class action lawsuit. Current and former employees may be able to recover lost wages and benefits brought upon by Faiveley, Wabtec and Knorr-Bremse conspiracy to "no poach" each other's employees, thereby limiting wages and depressing future employment prospects.

Good people, great products, product innovation, craftsmen mentality of long-time employees, profitable business and family-friendly culture.

Cons

Lack of a coherent business operating system; the enterprise needs to adapt an operational excellence mentality and culture. Several key personnel lack consistent and meaningful contact with customers thus the organization is too inwardly focused and does not have a clear picture of what the customer values and why they value it. Consequently, leadership makes mission critical decisions based on the internal environment and their biases instead of basing them on a sober reading of the market, customers, competitive landscape and a realistic assessment of the company's capabilities.
